 • Preneed Guardian Designation – You may name a person to act on your behalf as legal guardian in the event that you become incapacitated and need a court appointed guardian. Without a preneed guardian designation, the court could appoint someone who is a stranger to you as your legal guardian.

A Preneed Guardian Declaration must name the person or persons that you wish to become your guardian, and must be signed by you before two witnesses.  The Declaration should be deposited with the clerk of court for the county in which you reside so that the clerk of court may produce the declaration to the judge for consideration in any proceeding for the determination of your incapacity.
